Virginia police claims that Congressman Vito Fossella was driving under the influence on Thursday morning and took him into custody. 

The
New York congressman will hold a news conference on Friday at 1 pm to explain what happened.  His court appearance  to face the charges is scheduled for May 12.

Fossella was elected in 1997 and servers on the House Energy and Commerce Committee.  He was also a New York City Council member from 1994 to 1997.
